Terms and Conditions
We want our customers to be happy with your purchase. You can return the product if it is damaged or the order is incorrect. We will replace it or credit your account, subject to the below terms.
This policy forms part of the Baraka Beef terms and conditions. Words defined in the terms and conditions have the same meaning in this policy, unless the context indicates otherwise.
RETURNING PRODUCTS DAMAGED ON DELIVERY
Should a product be damaged or any parts or accessories are missed at delivery, please notify us within seven days of such delivery by logging a return via e-mail: orders@barakabeef.co.za. We will arrange to collect the product from you at no charge. Once we have inspected the product and validated your return, we will replace the product as soon as possible as per your choice.
You can return a damaged product to us at no charge, provided the following criteria have been met:
- It is unused, with the original labels and stickers still attached
- It is in its original packaging.
- It is not missing any accessories or parts
- You log a return on the website within seven days of delivery to you
DEFECTIVE PRODUCTS
We do our best to ensure that the products we deliver to you are of high quality, in good working order and without defects.
The following will not be regarded as defects and will not entitle you to a return under this section:
- Damage arising from negligence, user abuse or incorrect usage of the product
- Damage arising from a failure to care for the product adequately
- Damage arising from unauthorized alterations to the product
CHARGES AND REFUNDS
Suppose you return a defective product to us, but you fail to return all of the accessories and parts that were sold with that product; we are subject to applicable law and entitled to refuse the return, only to replace the item that you did return, or to estimate the value of the missing accessories and parts and only to credit or refund you in respect of the returned item. If you return a product that does not comply with this policy, Baraka Beef will be liable for the cost of collecting the product from you and the cost of having the product returned to you. Please note that we only refund the payment method you initially used – i.e., Payment by credit card will be refunded to the same credit card.
PRICING ON THE WEBSITE
Please note that the contract will only be concluded once Baraka Beef accepts the customer’s order. Pricing and deals can change at any time and will be at the sole discretion of Baraka Beef.
Conclusion of sales and availability of stock
- Registered users may order Goods, which Baraka Beef may accept or reject. Whether or not Baraka Beef accepts an order depends on the availability of Goods, the correctness of the information relating to the Goods (including without limitation to the price) and receipt of payment or payment authorization by Baraka Beef for the Goods.
- NOTE: Baraka Beef indicate the acceptance of your order by delivering the Goods to you or allowing you to collect them, and only at that point will an agreement of sale between you and Baraka Beef come into effect (the “Sale”). This is regardless of any communication from Baraka Beef stating that your order or payment has been confirmed. Baraka Beef will indicate the rejection of your order by cancelling it and, as soon as possible thereafter, refunding you for any amount already paid.
- Placing Goods in a wishlist or shopping basket without completing the purchase cycle does not constitute an order for such Goods. As such, Goods may be removed from the shopping basket if stock is no longer available or the price thereof might change without notice to you. You cannot hold Baraka Beef liable if such Goods are not available or are not available at the particular price when you complete or attempt to complete the purchase cycle at a later stage.
- You acknowledge that stock of all Goods on offer is limited and that pricing may change at any time without notice to you. In the case of Goods for sale by Baraka Beef, Baraka Beef will make all reasonable efforts to monitor stock levels and ensure that when stock is no longer available, offers thereof are discontinued on the website. However, we cannot guarantee the availability of stock. Baraka Beef will notify you, and you will be entitled to a refund of any amount you have already paid for such goods.
ORDERS AND PAYMENT
- Delivery policy: Subject to availability and receipt of payment, requests will be processed within 3 days, and delivery will be confirmed by e-mail.
- Export restriction: The offering on this website is available to South African clients only.
- Payment options accepted: Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the Baraka Beef bank account, the details of which will be provided on request.
- Card acquiring and security: Card transactions will be acquired for Baraka Beef via Payfast (Pty) Ltd, the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.payfast.co.za to view their security certificate and security policy.
- Customer details separate from card details: Baraka Beef will store customer details separately from card details, which the client enters on DPO PayGate’s secure site. For more information on DPO PayGate, refer to www.paygate.co.za.
- Merchant Outlet country and transaction currency: South Africa is The merchant outlet country when presenting payment options to the cardholder. The transaction currency is South African Rand (ZAR).
- Responsibility: Baraka Beef takes responsibility for all aspects of the transaction, including the sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
- Country of domicile: This website is governed by the laws of South Africa, and Baraka Beef chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature 255 Paul Kruger Street, Pretoria Central, Pretoria
- Variation: in its sole discretion, Baraka Beef may change this agreement or any part thereof at any time without notice.
Baraka Beef Let The Meat Steal The Show Competition – Terms and Conditions
- Introduction
1.1. The Let The Meat Steal The Show Competition (the “Competition”) is organised and administered by Baraka Beef (“the Promoter”).
1.2. By entering this Competition, all participants agree to comply with these Terms and Conditions, which shall be interpreted at the sole discretion of the Promoter. - Eligibility
2.1. The Competition is open to South African residents aged 18 years or older, excluding employees of the Promoter, their immediate family members, and any individuals professionally connected with the Competition.
2.2. Participants must have a valid Instagram account and comply with Instagram’s terms of service.
2.3. No purchase or entry fee is required to participate unless otherwise stated. - Competition Period
3.1. The Competition begins on 1 February 2025 and ends on 12 February 2025 at 3:00 PM SAST.
3.2. Entries received after the stated closing date and time will not be considered. - How to Enter
4.1. To enter the Competition, participants must:
4.1.1. Follow the official Baraka Beef page on Instagram to validate their entry.
4.1.2. Tag a friend on the “Let The Meat Steal The Show” post.
4.3. Entries must be posted before 3:00 PM SAST on the last day of the competition. Late entries will be disregarded.
4.4. Entries that contain offensive, inappropriate, or irrelevant content will be disqualified. Edited entries will not be eligible. - Prizes
5.1. The winner will receive a prize valued at 500 ZAR.
5.2. Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash. - Prize Collection:
6.1. Winners must respond to the Promoter’s direct message and provide any necessary details for prize delivery within 14 days of the announcement date.
6.2. If a winner fails to respond within the specified time frame, the prize will be forfeited.
6.3. Prizes will be delivered to the Winner’s specified address. For verification purposes, winners must present a valid form of identification (either an official South African ID book or driver’s licence) at the time of collection.
6.4. Prizes may differ slightly in appearance from the images shown in the promotional materials, which are for illustrative purposes only.- General Terms
7.1. By participating in the Competition, entrants consent to the use of their name, image, and likeness for promotional purposes related to the Competition, without any additional compensation.
7.2. The Promoter reserves the right to amend or cancel the Competition if unforeseen circumstances arise that are beyond its control.
7.3. The Promoter is not responsible for any loss, damage, or injury arising from participation in the Competition or acceptance of any prize.
7.4. The Promoter reserves the right to disqualify any participant who violates these Terms and Conditions or engages in fraudulent activity. - Privacy
